Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you and the developer of Bounce Connect ("we," "us," or "our"), concerning your access to and use of the Bounce Connect macOS application, the Bounce Companion Android application, and the bounceconnect.app website (collectively, the "Service").

By downloading, installing, or using the Service, you agree that you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these terms, you are expressly prohibited from using the Service and must discontinue use immediately.

Your use of the Service is also governed by our Privacy Policy. For information regarding your data subject rights (including GDPR), please review our Privacy Policy, which also governs the site and explains how the app operates locally and how permissions are used, available at bounceconnect.app/privacy.

Service Architecture & Distribution

Bounce Connect is a software utility designed to facilitate peer-to-peer communication between your personal Mac and Android devices over your local area network (LAN/Wi-Fi).

We do not operate servers to relay your data. Bounce Connect does not collect, store, or share personal data on external servers. All data transfer occurs directly between your devices over a local network. The app does not have access to or retain your data outside of your devices. The performance of the Service depends on your local network conditions. We are not responsible for issues caused by network instability, firewall restrictions, or device compatibility.

Official Distribution & macOS Security: Bounce Connect for macOS is officially distributed exclusively through bounceconnect.app and our official GitHub releases page. Because the macOS app is distributed outside the Mac App Store, it requires users to manually authorize it via macOS Privacy & Security settings (Gatekeeper). By doing so, you accept responsibility for this action on your device. We are not responsible for any harm, malware, or data loss caused by downloading the application from unofficial, third-party, or unverified sources. Always verify you are downloading from an official link before installation.

Please note that Bounce Connect is a convenience utility and should not be relied upon as a primary backup system or for mission-critical communications.

Disclaimer of Warranties ("AS IS")

To the fullest extent permitted by applicable law (including, where applicable, the Indian Consumer Protection Act, 2019), we disclaim all warranties, express or implied, in connection with the Service and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation. Nothing in these Terms is intended to exclude or limit any rights you may have under mandatory consumer protection laws in your jurisdiction.

We make no warranties or representations about the accuracy or completeness of the Service's operation and we assume no liability or responsibility for any:

• Errors, mistakes, or inaccuracies of content or functionality
• Physical damage to devices resulting from your access to and use of the Service
• Any interruption or cessation of transmission to or from the Service
• Any unauthorized access, interception, or malicious activity carried out by third parties on your local network, including but not limited to malware or data theft resulting from an unsecured or compromised Wi-Fi network.

No Third-Party Affiliation: Bounce Connect is an independent utility and is not affiliated with, endorsed by, or supported by WhatsApp, Telegram, Google, or any other third-party platform.

Limitation of Liability & Encryption

We built Bounce Connect with security as a priority. Data transmitted between your devices is encrypted using industry-standard AES-256-GCM encryption to protect your privacy within your local network. While we implement strong security measures, no system can be guaranteed to be completely secure. Security features are provided on a best-effort basis and may be updated or modified over time.

Because Bounce Connect facilitates transfers directly between your devices without any server oversight or cloud backups, to the fullest extent permitted by applicable law, we shall not be held responsible for any lost, corrupted, or delayed data.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of data, files, or media during network transfers
• Missed phone calls, SMS messages, or notifications
• Damage to your operating system or device hardware

This limitation applies even if we have been advised of the possibility of such damages and to the fullest extent permitted by applicable law. In no event shall our total liability to you for all damages exceed the amount paid by you for the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law. By using the app, you accept full responsibility for backing up your files and data prior to utilizing our transfer and synchronization features.

Device & OS Limitations: Performance of the Service may be affected by Android operating system battery optimizations, background restrictions, or manufacturer-specific power management policies beyond our control.

Communications Liability: You are solely responsible for any calls placed or SMS messages sent through the Service. We are not liable for unintended communications initiated via the app.

Acceptable Use & Network Security

You must be at least 13 years of age to use the Service. You may not access or use the Service for any purpose other than that for which we make the Service available. As a user of the Service, you agree not to:

• Use the Service to transmit illegal, infringing, or malicious files.
• Attempt to bypass or interfere with the encryption or security features of the Service.
• Reverse engineer, decompile, or disassemble any aspect of the software.
• Use the app on networks where you do not have permission to transmit local traffic.

Data Access Authorization: Bounce Connect requests access only to the data required for its core features (such as message syncing, notifications, and call handling). Access is requested at runtime and is used solely for the features explicitly enabled by the user. No data is accessed by default or transmitted to external servers.

User Responsibility: You are responsible for ensuring that your use of the app complies with applicable laws and does not violate the privacy or rights of others, including when accessing messages, calls, or files through connected devices.

Your Network Security: Because the software operates on your local Wi-Fi, it is your responsibility to ensure your Wi-Fi network is secure (e.g., using WPA2/WPA3 encryption). We are not responsible if an unauthorized party intercepts data on an open or compromised network.

Termination: We reserve the right to revoke your license to use the Service if you are found to be violating these acceptable use terms or attempting to reverse engineer the application. Note: license termination for acceptable use violations means refund eligibility may be affected, subject to Google Play policies and applicable law.

Purchasing & Refunds

The Bounce Connect Android companion application is available as a one-time purchase on the Google Play Store, providing lifetime access. The macOS application is free. By using the Service, you agree to the following regarding refunds and pricing:

• Refunds: All purchases for the Android application are processed through the Google Play Store. You may request a refund directly through Google Play, typically within 48 hours of purchase. After this window, refund eligibility is subject to Google Play's policies and applicable laws. • macOS App: The macOS application is available as a free download through bounceconnect.app and our official GitHub releases page. No purchase is required.
• Pricing & Updates: We reserve the right to alter the purchase price of the Service for new customers at any time without prior notice. Existing purchasers retain lifetime access to the Service, including all future updates and added features (to the extent technically possible and not prevented by changes to third-party platforms or operating systems), regardless of future price changes.

Intellectual Property Rights

Unless otherwise indicated, the Service is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service, and the trademarks, service marks, and logos contained therein, are owned or controlled by us.

You are granted a limited, non-exclusive, non-transferable license to download and run the software on your own personal devices. You may not distribute, sublicense, or modify the software without our express written permission.

Modifications and Interruptions

We reserve the right to change, modify, or remove the contents or features of the Service at any time or for any reason at our sole discretion; however, core purchased functionality will not be removed without in-app notification or email notice to existing users. We will also alert you about general changes by updating the "Effective Date" of these Terms.

We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, including the Consumer Protection Act, 2019.

Subject to applicable consumer protection laws, you and Bounce Connect agree that any disputes arising out of or in connection with these Terms shall be subject to the jurisdiction of the courts located in Andhra Pradesh, India.

Nothing in these Terms shall affect any mandatory statutory rights that cannot be waived or limited by contract under the applicable laws of your jurisdiction.
